2. DEFINITIONS OF SERVICE

You understand and agree that our current Service changes, features and enhancements shall be subjected to the TOS. Our Service is provided "as it is". Should the user accidentally delete or amend details on their own accord, our Service assumes no responsibility for the deletion, mis-delivery or failure to store the user’s accidental content or settings’ amendments.

You are responsible for the payment of fees in order to use our Service and obtain access to it, which in particularly addresses the Internet Service Provider charges. In addition, you must provide all equipment necessary to access the Service and are responsible for it.

3. USE OF SERVICE

By using the Service, you have agreed to ensure that the usage of the Service will comply with all applicable laws, ordinances, codes, rules, regulations, notices, instructions or directives of the relevant authorities or with any notices given by M3 Tech in connection with M3 Tech Services. Such applicable laws or regulations shall include but not be limited to those relating to subversive, defamatory, obscene or pornographic materials, or other content standards or breach of copyright, patent or other proprietary rights, or in a manner which in the reasonable opinion of M3 Tech may adversely affect the use of the Services by other users of M3 Tech that pertains to the efficiency of the System or M3 Tech Service as a whole.

4. INVOICING AND PAYMENT

M3 Tech reserves the right to invoice you in correspondence to your Service subscription plan. M3 Tech will notify you via email within 30 days prior to the end of your subscription plan. Upon receiving our email notice, you can either continue using the Service, hence allows M3 Tech to renew your existing subscription plan for you to make payment, or you can upgrade or cancel your subscription plan. All payment shall be Payable to "M3 Technologies (Asia) Berhad".

M3 Tech reserves the right to change the Free Trial time period at its own discretion. All Free Trial registered users will receive an email notification from M3 Tech regarding any new changes. Please refer to item No. 9 for further information about notice.

5. PRIVACY POLICY - ACCOUNT, PASSWORD & SECURITY

All written / visual information of any kind, whether printed or electronic format, including but not limited to technical information, data, know-how and information relating to either Party's (or its respective holding, related or subsidiary companies') business, marketing strategies, financial condition and operations whether or not labelled as "Confidential" and submitted by one Party to the other shall be categorised as “Confidential Information”.

7. DECLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IT IS" AND "AS AVAILABLE" BASIS. M3 TECH EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM M3 TECH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THE TOS.
